THE CARD · TERMS OF USE

Effective date: 11/06/2026

These Terms of Use are an agreement between you and The Golf Card, LLC ("The Golf Card," "we," "us," or "our"), the company that operates The Card, a golf scoring and standings application available at golfcardplay.com and in any related application (together, the "App").

By creating an account, subscribing, or otherwise using the App, you agree to these Terms. If you do not agree, do not use the App. The App is provided strictly for entertainment purposes, and may not be used for betting, wagering, or gambling of any kind.

PLEASE READ SECTIONS 16, 17, 19, 20 AND 26 CAREFULLY. They explain that golf is played entirely at your own risk and that we are not responsible if you or anyone else is injured, that our liability to you is limited to one hundred dollars, that you agree to cover certain claims, and how disputes between us are resolved.

1. ACCEPTANCE AND CHANGES TO THESE TERMS. These Terms apply every time you use the App. We may update them, and when we do we will change the effective date above and, where the change is material, ask you to read and accept the updated Terms before you continue. A record of the version you accepted and the date you accepted it is kept on your account. If you do not accept an updated version you must stop using the App; continuing to use it after an update means you accept it.

2. WHO MAY USE THE APP. You must be at least 18 years old and able to enter into a binding contract to create an account. The App is intended for a general, adult, recreational audience and is not directed to children. You may not use the App if we have previously terminated your account or barred you from it. If you are a parent or guardian and you believe a child has created an account, contact us at support@golfcardplay.com and we will close it and delete the information we hold.

3. YOUR ACCOUNT. An account is tied to your mobile telephone number, and you sign in by receiving a code at that number. You are responsible for keeping that number and that device secure, and for everything done through your account, whether or not you did it. An account is for one person. Do not share it, sell it, or let anyone else sign in as you. Tell us promptly at support@golfcardplay.com if you believe someone else has gained access to your account or if you stop controlling that telephone number, and we will help you move or close it. We may refuse to issue, or may reclaim, a telephone number or display name that impersonates somebody else.

4. LICENSE. Subject to these Terms, The Golf Card grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your own personal, recreational golf scorekeeping. All rights not expressly granted are reserved.

5. OWNERSHIP. The App, its design, its source code, its text, its graphics, the name The Card, and everything else we have put into it are owned by The Golf Card, LLC and are protected by copyright, trademark and other laws. Nothing in these Terms transfers any of that to you. Course information displayed in the App, including names, pars, stroke indexes, ratings and slopes, is supplied by a third-party database and belongs to its owner.

6. RESTRICTIONS. You agree not to: copy, modify, reverse engineer, decompile, or create derivative works from the App; access it by any automated means, including scrapers, bots and crawlers; extract, copy or redistribute the course database or any substantial part of it; resell, sublicense or commercially exploit the App or access to it; interfere with its operation, security, or availability, or attempt to gain access to any part of it you have not been granted; remove or obscure any proprietary notice; use the App to break any law; or use the App in any way these Terms do not permit.

7. RECREATIONAL USE ONLY; NO GAMBLING. The App is a scorekeeping and standings tool for recreational golf. It is provided strictly for entertainment purposes, and may not be used for betting, wagering, or gambling of any kind.

You agree that you will not use the App for betting, wagering, or gambling, and that you will not use it to organise, promote, administer, record or settle any bet, wager, stake, pool, entry fee, prize, or other arrangement involving money or anything else of value. The App charges no entry fee, holds no stake, awards no prize, and processes no payment between users. It does not handle money of any kind other than the subscription fee you pay us. All scores, points, standings, skins, matches, presses, rolls and results shown in the App are points kept for entertainment. They have no monetary value, cannot be redeemed for anything, and are not a record of any obligation between you and anybody else. Words such as "press" and "roll" describe how points are counted in a game format and do not refer to money. Anything you and your playing partners agree between yourselves is entirely between you, happens outside the App, and is no business of ours.

8. PLAYERS YOU ADD. The App lets you add other people to a round or a trip by entering a name, and optionally a handicap index and a telephone number, so that scores can be kept for them. If you do this, you confirm that you are entitled to enter that information, that the person is content for you to keep score for them, and that you will tell them, if they ask, that their name and scores appear in the App. You are responsible for the information you enter about another person. If somebody you added asks us to remove their information, we will remove it, and we may do so without notifying you.

9. YOUR CONTENT. You are responsible for everything you enter into the App, including player names, team names, trip names, course notes and scores ("Your Content"). You keep ownership of Your Content. You grant The Golf Card a worldwide, non-exclusive, royalty-free license to store, copy, display and transmit Your Content for the purpose of operating the App, including showing it to the other players in your round or trip and to anyone you give a room code or trip code to. That license ends when you delete the content or your account, except for copies held in routine backups for a limited period. You agree not to enter anything unlawful, abusive, defamatory, obscene, hateful, or that impersonates somebody else or infringes anybody's rights. We do not routinely review Your Content, but we may remove anything that breaches these Terms.

10. SUBSCRIPTIONS, FREE TRIALS AND AUTOMATIC RENEWAL. Keeping score in the App requires a paid subscription for the person keeping score. Other players can follow a shared round without an account and without paying.

The subscription costs the amount shown in the App at the time you subscribe, is billed in advance, and runs for the period shown at checkout. Your subscription renews automatically at the end of each period, and the payment method you gave us is charged the then-current renewal price, until you cancel. The price, the renewal date and the renewal amount are shown to you before you pay, and again on the Account screen at any time.

If a free trial or a promotional price is offered, the length of the trial or promotional period, the date it ends, and the price you will be charged when it ends are shown to you before you give us a payment method. We will send a reminder to the email address on your account before the first charge after a free trial. Only one free trial is available per person, whether taken as a trial code or as a trial at checkout. A trial or promotional price is for new subscribers unless we say otherwise, and we may withdraw or change an offer at any time before you accept it.

11. CHANGES TO THE PRICE. We may change the price of a subscription. If we do, the new price applies from your next renewal, and we will tell you by email at least thirty days before that renewal. If you do not want to pay the new price, cancel before the renewal date and you will not be charged it.

12. CANCELLING. You may cancel at any time, for any reason, from the Account screen in the App. It takes two taps and does not require you to contact us, call anybody, or visit another website. When you cancel, your subscription remains active until the end of the period you have already paid for, your subscription is not renewed, and your payment method is not charged again. If you cancel during a free trial you will not be charged at all. You may also cancel by emailing support@golfcardplay.com, and we will action it.

Deleting the App, removing it from your device, or simply not using it does not cancel a subscription.

13. REFUNDS. Except where the law requires otherwise, subscription fees already paid are not refunded, including for a period you did not use, and cancelling does not produce a refund of the current period. Nothing in this section takes away any refund right you have under the consumer-protection law of the place you live.

14. FAILED PAYMENTS. If a payment fails we will attempt it again over a period of up to fifteen days, and our payment processor may contact you to update your payment method. While a payment is outstanding your access may be suspended. If payment has not succeeded by the end of that period, the subscription is cancelled and paid access ends. You can subscribe again at any time.

15. AVAILABILITY AND OUTAGES. The App is provided on an "as available" basis. The Golf Card does not promise that the App will be available at any particular time, that it will work on every device, browser, or network, or that it will be free of interruption, delay, or error. Access may be unavailable, slow, or degraded because of maintenance, an update, a fault in the App, or the failure of someone we rely on, including our cloud provider, our payment processor, the course database, your mobile carrier, or your own internet connection. We may change, suspend, limit, or discontinue the App or any part of it at any time, with or without notice, and we are not required to give you advance warning of an outage. Information you enter may be delayed, lost, or recorded incorrectly, including while the App is unavailable in the middle of a round. Keep the paper scorecard. The scorecard, not the App, is the record of your round. An outage does not extend or refund any part of your subscription, except where the law requires it.

16. GOLF IS PLAYED AT YOUR OWN RISK. This section is important and you should read it in full.

The App is software. It keeps score. It does not supervise your round, it does not choose where or when you play, and nobody from The Golf Card is present when you play. The App is provided strictly for entertainment purposes, and may not be used for betting, wagering, or gambling of any kind.

Golf carries an inherent risk of serious injury and of damage to property. Those risks include, without limitation: being struck by a golf ball, a golf club, or a tee marker; falling, slipping or tripping on a course, a path, a bunker, a slope, steps, or wet or uneven ground; collisions, roll-overs, falls from, and other accidents involving golf carts, whether driven by you or by anybody else; contact with trees, water hazards, bunkers, fences, maintenance equipment, vehicles, wildlife, insects and plants; lightning, heat, cold, sun, wind and other weather; exertion, dehydration, heart conditions, and other medical events; and the acts, omissions, carelessness or recklessness of other golfers, of your playing partners, of course staff, and of anybody else present.

You knowingly and voluntarily accept all of those risks. You are solely responsible for deciding whether you are fit to play, for playing safely, for obeying the rules of the course and the instructions of its staff, for your own and your playing partners' safety, and for the safe operation of any golf cart or other equipment you use.

You are responsible for using the App safely. Do not look at your phone while swinging, while a ball is in the air, while driving or riding in a golf cart, while walking across uneven ground, or at any other moment when doing so could put you or anybody else at risk. Entering scores can wait. If using the App would distract you or anybody near you from what is happening on the course, put it away.

To the maximum extent permitted by law, you release, waive, discharge and agree not to sue The Golf Card, LLC and its members, managers, officers, employees, contractors and suppliers from and for any and all claims, demands, damages, losses, injuries, costs and causes of action of any kind, whether known or unknown, and whether arising from negligence or otherwise, relating to or arising out of: any injury, death, illness, or damage to property occurring before, during or after a round in which the App was used; the condition of any golf course or facility; the conduct of any golfer, playing partner, course operator or other person; your use of the App while on a golf course or anywhere else; and anything you were doing, or failed to do, while using the App.

We have no involvement in and no responsibility for how, where, with whom, or whether you play golf. We do not own, operate, inspect, maintain, staff or supervise any golf course, and the presence of a course in the App is not a recommendation of it, a statement about its condition or safety, or any relationship between us and its operator.

If you live in California, you also waive California Civil Code section 1542, which provides that a general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in their favour at the time of the release, and that if known would have materially affected their settlement with the debtor or released party.

17. THIRD PARTY SERVICES. The App depends on services operated by other companies. These include, at the date above: Stripe, which processes subscription payments and stores payment methods; Google and its Firebase platform, which provides sign-in, the database, the hosting and the server functions; your mobile carrier, which delivers the sign-in code by text message; a third-party golf course database, which supplies course names, pars, stroke indexes, ratings and slopes; and an email delivery provider, which sends the messages we send you. We may add, change or replace any of them.

Those companies are not controlled by us. Their own terms and privacy policies govern what they do. To the maximum extent permitted by law, we are not responsible or liable for any act, omission, error, delay, outage, security incident, data loss, change of terms, price change, discontinuation, or other failure of any third-party service, or for any loss or damage of any kind arising from one. That includes, without limitation: a payment that fails, is duplicated, is delayed, or is processed incorrectly; a sign-in code that does not arrive or arrives late; an outage that makes the App unavailable in the middle of a round; scores or other information that are lost, delayed or corrupted; course information that is wrong or out of date; and an email from us, including a reminder before a charge, that is delayed, blocked, filtered or never delivered.

You agree that your sole remedy in respect of a third-party service is against that third party, and you agree to indemnify and hold us harmless as set out in Section 20 in respect of any claim you bring or any loss you suffer arising from one. The App may also contain links to websites we do not operate. We do not endorse them and are not responsible for them.

18. NO WARRANTY. The App is provided strictly for entertainment purposes, and may not be used for betting, wagering, or gambling of any kind. The App is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, accuracy, or non-infringement. The Golf Card does not guarantee the App will be uninterrupted, timely, secure, error-free, or accurate. Course information, including pars, stroke indexes, ratings and slopes, comes from third-party sources and may be wrong or out of date; check it against the scorecard. Scores, handicap strokes, standings and game results are calculated by the App for your entertainment and are not an official record of play. They are not certified by, and have no standing with, any golf association, handicap authority, or competition organiser. Where the App and the committee or scorecard in front of you disagree, the scorecard governs. No advice or information, whether oral or written, obtained from us creates any warranty not expressly stated here.

19. LIMITATION OF LIABILITY. In this section and the two that follow, "we" and "us" mean The Golf Card, LLC together with its members, managers, officers, employees, contractors, and suppliers.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, personal injury, emotional distress, or business interruption, whether or not we were told such damages were possible and whether the claim is brought in contract, tort, negligence, strict liability or otherwise.

To the maximum extent permitted by law, we are also not liable for: (a) the App being unavailable, interrupted, delayed, or inaccessible, for any length of time and for any reason; (b) scores, handicap strokes, standings, game results, or course information that are wrong, incomplete, delayed, or lost, including where the cause is information that you or another user entered incorrectly, entered for the wrong player or hole, or did not enter at all; (c) any decision anyone makes in reliance on something the App displays; (d) any money or anything else of value that anyone loses, pays, or does not receive in connection with an arrangement between players, which the App does not handle and is not a party to; (e) any disagreement between users, including a disagreement about a score, a result, or how a game was settled; (f) any act or omission of a third-party service, as described in Section 17; (g) any injury, death, illness or property damage described in Section 16; and (h) any unauthorised access to or alteration of your information, where we have taken reasonable measures.

Our total liability to you for all claims relating to the App, however they arise and however many claims there are, will not exceed one hundred dollars ($100.00).

Some places do not allow some of these exclusions or limits, so part of this section may not apply to you, and nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by our own negligence where that limit is not permitted.

20. INDEMNIFICATION. You will defend, indemnify, and hold us harmless from and against any claim, demand, loss, liability, damage, fine, penalty, or expense, including reasonable legal fees and costs, arising out of or relating to: your use of the App; information you entered about another person; anything you made visible by giving out a room code or trip code; Your Content; your breach of these Terms or of any law; any arrangement, dispute or settlement between you and anybody else; any injury, death or property damage connected with a round in which you used the App; and any claim brought by you or on your behalf against a third-party service arising from your use of the App. We may assume the exclusive defence of any matter subject to indemnification by you, in which case you will cooperate with us.

21. SUSPENDING OR BLOCKING YOUR ACCESS. We may suspend, restrict, block or terminate your access to the App, in whole or in part, immediately and without notice, if we reasonably believe that you have breached these Terms, that you have used the App for betting, wagering or gambling, that you have used it unlawfully or to harm or harass another person, that you have entered information about another person without being entitled to, that your account is being shared or used by somebody else, that you have attempted to interfere with the App's operation or security, that continued access presents a risk to us, to other users, or to a third-party service we depend on, or that we are required to act by law.

We may also decline to provide the App to any person, and may close any account, at our discretion. Where we close an account that has a paid subscription and the reason is not a breach by you, we will refund the unused part of the period you have paid for. Where we close an account for a breach, no refund is due. You may close your own account at any time by contacting us. Sections 5, 7, 8, 9, 13, 16, 17, 18, 19, 20, 24, 25, 26 and 27 survive the end of this agreement for any reason.

22. ELECTRONIC COMMUNICATIONS. By creating an account you consent to receive communications from us electronically, including by text message to the number on your account and by email to the address on your account. Those communications include the code you need to sign in, notices about your subscription such as a reminder before the first charge after a free trial, receipts, and notices about these Terms, your account, or the App. These are service messages and you cannot opt out of them while you hold an account, though you can close your account at any time. Marketing messages are separate: we send them only if you have turned on "Golf offers and news" in your account, and you can turn it off at any time. Message and data rates may apply, and we are not responsible for a message that your carrier delays, blocks or fails to deliver. You agree that electronic communications satisfy any legal requirement that a communication be in writing.

23. FEEDBACK. If you send us an idea, suggestion, or feedback about the App, you agree we may use it for any purpose, without restriction, attribution or payment to you, and that doing so creates no obligation of confidence between us.

24. GOVERNING LAW AND VENUE. These Terms, and any dispute arising out of or relating to them or to the App, are governed by the laws of the State of Illinois, without regard to its conflict-of-law rules. Subject to Section 26, you and we agree that the state and federal courts located in Cook County, Illinois have exclusive jurisdiction, and you and we each consent to that jurisdiction and waive any objection to it. Nothing here takes away a right you have under the consumer-protection laws of the place you live, or your right to bring a matter in a small claims court that has jurisdiction over it.

25. TIME LIMIT ON CLAIMS. To the maximum extent permitted by law, any claim arising out of or relating to these Terms or to the App must be brought within one year after it arises, and after that it is permanently barred.

26. RESOLVING A DISPUTE. If you have a problem, contact us first at support@golfcardplay.com. You and we agree to try in good faith to resolve any dispute informally for sixty days from the date one of us notifies the other of it in writing. Most things can be settled this way.

You and we each waive any right to a trial by jury, and each agree that any dispute will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. An arbitrator or court may not consolidate more than one person's claims or preside over any form of representative or class proceeding. If this paragraph is found unenforceable in whole or in part, the remainder of this section still applies, and the unenforceable part is severed.

27. GENERAL. These Terms, together with the Privacy Notice, are the entire agreement between you and The Golf Card about the App, and replace anything said or written before. If any provision is found unenforceable, it is modified to the minimum extent necessary or severed, and the rest remains in force. Our failure to enforce a provision is not a waiver of it, and no waiver is effective unless we give it in writing. You may not assign or transfer these Terms or your account; we may assign them, including to a successor in connection with a merger, acquisition or sale of assets. There are no third-party beneficiaries to these Terms. Neither of us is liable for a failure to perform caused by something beyond our reasonable control. Headings are for convenience and do not affect interpretation.
